  • Q1 我的家人因精神或智能障礙,並有受監護宣告之情形,應如何辦理保險事宜跟需要注意的? | My family member has a declaration of guardianship due to mental or intellectual disability. How should insurance matters be handled and what should be noted?

    如要保人或被保險人因精神或智能障礙,並有受監護宣告之情形時,應由其法定代理人或監護人辦理投保、契約變更(契約批改)、理賠等事宜。法定代理人或監護人為受監護宣告者初次辦理保險業務,應檢附該要保人或被保險人受監護宣告之證明文件。另外在保險法第107條之一規定:訂立人壽保險契約時,以受監護宣告尚未撤銷者為被保險人,除喪葬費用之給付外,其餘死亡給付部分無效。前項喪葬費用之保險金額,不得超過遺產及贈與稅法第十七條有關遺產稅喪葬費扣除額之一半。

     

    When the applicant or insured has a declaration of guardianship due to mental or intellectual disability, the legal representative or guardian shall handle matters such as insurance application, policy changes (policy endorsements), and claims. When a legal representative or guardian handles insurance business for the first time on behalf of a person under guardianship declaration, supporting documents proving the applicant's or insured's guardianship declaration status must be attached. Additionally, Article 107-1 of the Insurance Act stipulates: When entering into a life insurance contract with a person under guardianship declaration that has not been revoked as the insured, except for funeral expense benefits, all other death benefits are invalid. The insurance amount for funeral expenses as mentioned in the preceding paragraph shall not exceed half of the funeral expense deduction for estate tax as specified in Article 17 of the Estate and Gift Tax Act.

  • Q4 因故班機取消需滯留在當地1晚,旅平險會自動延長保險時效嗎?延長的時間內保障範圍一樣嗎? | If my flight is cancelled and I need to stay one more night, will my travel insurance automatically extend? Will the coverage remain the same during the extension?

    本保險契約的保險期間,以本保險契約保險單上所載日時為準。(不會自動延長時效)

    如被保險人以乘客身份搭乘領有載客執照之交通工具,該交通工具之預訂抵達時刻係在本保險契約的保險期間內,因故延遲抵達而非被保險人所能控制者,本保險單自動延長有效期限至被保險人終止乘客身份時為止,但延長之期限不得超過24小時。

    (白話解釋:若保單到期的時間被保險人還在飛機上,保期可自動延長至飛機降落,但最長不超過24小時)

     

    The insurance period is based on the dates specified in the policy (no automatic extension).
    However, if the insured is traveling as a passenger on a licensed carrier scheduled to arrive within the policy period, and the delay is beyond the insured's control, the policy will automatically extend until the insured's passenger status ends, but not exceeding 24 hours. (In simple terms: If the policy expires while the insured is still on the plane, coverage extends until landing, but not beyond 24 hours)

    旅平險一次最多投保180天,超過不可延長。

     

    Travel insurance can only be purchased for a maximum of 180 days at a time, no extensions beyond this period.
